Agreement to Our Legal Terms

We are Anchor Multi ("Company," "we," "us," "our"), a company located at 1640 N Water St, Milwaukee, WI 53202. You can contact us at matthew@anchormulti.com.

These Terms of Use constitute a legally binding agreement between you and Anchor Multi governing your use of our platform and services (the "Services"). By accessing or using the Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement. The Services are intended for use by residential tenants, property managers, and portfolio operators of multifamily residential buildings. Use for any other purpose requires our prior written consent.

2. User Accounts

Access to the platform is by invitation only. You may receive an invitation from your property manager or from us directly. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at matthew@anchormulti.com if you suspect unauthorized access to your account. We reserve the right to terminate accounts at any time for any reason.

3. Permitted Use

You may use the Services only for lawful purposes and in accordance with these Terms. Permitted uses include:

  • Communicating with neighbors and building management through the platform;
  • Submitting and tracking maintenance requests;
  • Participating in building events and the community rewards program;
  • Accessing building announcements and package notifications;
  • Managing your building's residents and settings (for property managers and portfolio operators).

4. Prohibited Activities

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
  • Post, transmit, or share content that is defamatory, obscene, harassing, threatening, hateful, discriminatory, or otherwise objectionable;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Attempt to gain unauthorized access to any portion of the Services, other user accounts, or related systems;
  • Interfere with or disrupt the integrity or performance of the Services or the servers and networks connected to them;
  • Scrape, crawl, or collect data from the Services using automated means without our prior written consent;
  • Transmit any malware, viruses, or other destructive code;
  • Use the Services to send unsolicited communications (spam);
  • Reverse engineer, decompile, or disassemble any portion of the Services;
  • Resell, sublicense, or commercialize the Services or any portion thereof without our prior written consent;
  • Use the Services to collect or store personal information about other users without their consent;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.

5. User Content

You retain ownership of content you submit through the Services ("User Content"). By submitting User Content, you grant Anchor Multi a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content solely to operate and provide the Services. You represent and warrant that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.

We do not endorse any User Content and are not responsible for the accuracy, completeness, or legality of any User Content. We reserve the right to remove any User Content at our sole discretion.

6. Intellectual Property

The Services and all content, features, and functionality (including but not limited to software, text, graphics, logos, icons, and images) are owned by Anchor Multi or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any portion of the Services without our prior written consent.

7. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.

8. Third-Party Services

The Services may integrate with or link to third-party services, including but not limited to Supabase (database and authentication), OpenAI (AI-generated content), and Vercel (hosting). Your use of any third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED CONTENT (INCLUDING RENEWAL RISK SCORES AND RETENTION NOTES) IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANCHOR MULTI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Anchor Multi and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Term and Termination

These Terms are effective as long as you use the Services. We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Sections 5 (User Content), 6 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 13 (Dispute Resolution), and 14 (Governing Law) shall survive termination.

13. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to first contact us at matthew@anchormulti.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice. If we cannot resolve the dispute informally within 30 days, either party may proceed to binding arbitration as described below.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as modified herein. The arbitration shall be conducted in English and shall be seated in Milwaukee, Wisconsin. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NO ARBITRATION OR PROCEEDING SHALL BE JOINED WITH ANY OTHER; (B) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED OR RESOLVED ON A CLASS-ACTION BASIS; AND (C) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS.

Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14. Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws principles, except to the extent that federal law applies.

15. Modifications to the Services

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

16. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page. Your continued use of the Services after any changes constitutes acceptance of the new Terms. We will provide notice of material changes by email or through an in-app announcement at least 14 days before they take effect.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Anchor Multi with respect to the Services and supersede all prior and contemporaneous agreements, representations, and understandings.
